FACTS: On Feb. 5, 2009, at 4 p.m., plaintiff Teresa Zesati, a 58-year-o ld unemployed, had exited a city bus and was walking in the crosswalk at Ramona Boulevard and Peck Road in El Monte. After she cleared the crosswalk, she was struck on the left side of her body by a vehicle. The driver of that vehicle lost control on the wet roadway.

DEFENDANT’S CONTENTIONS: AAA claimed that the impact was not significant since plaintiff did not suffer any broken bones, bruises, cuts or any other physical evidence of injury. Moreover, according to the EMS, and emergency room records, there was no evidence of loss of consciousness and no objective signs of a concussion. CT scans of the brain and subsequent MRIs of the brain were all within normal limits.
