Sark Ohanian of Carpenter, Zuckerman & Rowley won a major civil rights victory against a national retail chain resulting in the chain dropping their policy of requiring employees to wear “gender appropriate clothing.”
Sark represented a lesbian of Asian descent whose physical appearance was perceived by her employer to be too masculine. The plaintiff was qualified for a promotion to the chain’s flagship store. The plaintiff was denied the promotion, however, because her physical appearance was not in conformity with the overtly feminine image the retailer uses to promote itself to young women.
Sark successfully argued that corporate policies which require “gender appropriate clothing” discriminate against gay, lesbian, bisexual, and transgender employees. After resolving the lawsuit, the retailer dropped its “gender appropriate clothing” employee policy.
