LA Ranks #2 for Mail Carrier Dog Attacks

Next to children and the elderly, mail carriers are one of the most frequent victims of dog attacks in Los Angeles. The United Postal Service reported that there 5,500 mail carriers were attacked by dogs in 2013. Ranking a close second to Houston on that list is Los Angeles with 61 dog bite injuries inflicted on mail carriers in 2013.

Observing dog bite safety measures can prevent dog attacks, but if you or a loved one have suffered a dog bite injury, California law allows you to recover damages for dog bite injuries.

Dog Bite Prevention

Any dog, regardless of breed or size, can bite in reaction to stimulus around them. They can bite when:

  • In a stressful situation
  • Sick or not feeling well
  • Scared or threatened
  • Overly excited while playing

While dogs can be friendly and adorable, the American Veterinary Medical Association recommends that people avoid petting them when:

  • The owner is not with the dog
  • The dog is eating or sleeping
  • The dog is injured or sick
  • The dog is resting with her puppies
  • The dog is playing with a toy
  • The dog is hiding or spending time alone in its special place
  • A dog is barking or growling

Injuries from Dog Attack

Depending on the size of the dog and the victim of the attack, a dog bite can cause lacerations, puncture wounds and head injury, all of which require medical attention. In serious cases, a dog attack can be fatal, particularly for very young children and the elderly. If you or a loved one is involved in a dog bite accident or dog attack, you may be entitled to compensation under California tort law.

Claiming Damages

The state of California has a dog bite statute, Civil Code Sec. 3342, which allows the injured victim of a dog attack to claim damages against the owner of the dog. The law does not require that the owner be able to anticipate the attack or be aware of the viciousness of his dog.

Your claim for damages can include costs of medical bills, ongoing therapy, lost earnings, and pain and suffering.
